FLSA exemption, defined

The Fair Labor Standards Act (FLSA) requires overtime pay for most workers, but "white-collar" employees can be exempt if they meet three tests: they are paid on a salary basis, that salary meets a minimum salary level ($684/week federally), and their duties are primarily executive, administrative or professional. Failing any one test makes the employee non-exempt and entitled to overtime.

The formula

exempt = salary basis AND weekly ≥ $684 AND duties qualify
regular rate = weekly pay ÷ 40
overtime pay = regular rate × 1.5 × (hours − 40)

Worked example

An employee earns $800/week but their duties don't qualify. They pass the salary level ($800 ≥ $684) yet fail the duties test, so they are non-exempt. Working 48 hours: regular rate = $800 ÷ 40 = $20, overtime = $20 × 1.5 × 8 = $240 extra.
